Matrimonio gay en Colombia: Desenlace / Gay Marriage in Colombia: the aftermath

If
we have to blame someone in the outcome, it should be those who drafted the Colombian 1991 Constitution, which was not inclusive enough. Its 42nd article defines marriage as a union of man and woman, and the Constitutional Court, as in its usual demagoguery, could not point "black" where it said "white."

I'll never understand (unless the plaintiffs counted with the potential arbitrariness of the Court) why it was necessary to sue the Civil Code (unless trying to prove that a 1887 definition of marriage is outdated, that is), when the law of laws, a.k.a. the Constitution becomes the real problem.

I do not think the LGBT community will be happy with the fact with that within two years gays will celebrate a civil union similar to marriage, but I am not expecting that within the next two years the Congress will legislate or amend the constitution after eight debates. First of all and to my knowledge, the LGBT community is seeking full equality before the law; i.e., marriage, and the term "civil union" may please only some conservatives and Elton John. Secondly, the advance of the LGBT community cause have usually everything to do with the judiciary and not with the legislative or executive.

Not to be pessimistic, but the way to civil rights in the Congress will be very convoluted and full of obstacles.

Note to Chicken Little: Gay Marriage was approved in NY and STILL the sky isn’t falling at all

It’s another day of joy for the Finch, a/k/a the Progressive Hero, but first and most of all for the LGTB community in New York, of course. The Senate just recognized in the last hours of yesterday by a 33-29 margin, the right for same – sex couples to marry.

Another step in the long and excruciating way to achieve equality under the law for the LGBT population everywhere and I offer right here my heartiest congratulations to those who relentlessly fought for this accomplishment.

I’m not that into the sipmac team’s political orientation (as you may have noticed), but I need to quote Ms. Cynthia Yockey and Gay Patriot about the historical decision:
Prof. Reynolds, unalienable rights that are opposed by a majority are going to have to be imposed by courts. It is not acceptable to gays to be fully human in one state and not in another. It is antithetical to the concept of unalienable rights. Such a checkerboard also is a source of economic and social stagnation.

Cynthia Yockey
With the success in New York, it’s time (well, it’s long past time) to move the debate from the courts to the legislatures, as has happened in that state. And once it’s gone through the legislatures, indeed, even as it’s going through the messy process of law-making in other jurisdictions, it’s important we consider state-recognized marriage as more than just personal validation, more than a trophy in the culture wars, but also as an ancient and honorable institution which imposes duties on those who seek its protections and gain privileges from the state.

Gay Patriot

Chicken Little, the sky’s not gonna fall at all. Just let it go for good.
